This presentation will focus on how habitual residence is determined in The Hague Child Abduction Convention cases in Canada, the Unites States and Mexico and in particular how it was redefined in light of the 2020 US Supreme Court judgment in Monasky v. Taglieri and the 2018 Supreme Court of Canada judgment in The Office of the Children’s Lawyer v. Balev.
